To see if your circumstances are suitable for using the Australian Legal Will, simply undertake the Free Suitability Questionnaire.

If you do not have a Will upon passing, you are said to have died intestate. This means your estate and assets will be sold and distributed according to a specific formula outlined in the Administration and Probate Act 1958. Therefore, your estate and assets may not be distributed how you want. This is why it's important to have a valid Will and register its location, so loved ones can easily locate and execute it according to your wishes.

After completing the Free Suitability Questionnaire, if your circumstances are deemed unsuitable for using the Australian Legal Will, you can opt to receive free referrals from lawyers that have partnered with us across Australia. This way, a lawyer can get in contact with you to discuss making a Will (suitable to your circumstances), and any other documents you may require. Once a referral has been made, there is no further engagement with the Registry, and it is your choice as to whether you would like to proceed with the referred lawyer. Note, the Registry operates independently from any referred lawyers and does not endorse them or their services.

The Australian Registry of Wills, Deeds and Documents is a national information center that allows you to make a simple Will online, register and identify the location of important documents, share precious Memories with loved ones, and create your Intentions (i.e. statement of wishes for your executor; child guardianship wishes; funeral arrangements; eulogy/obituary notes).

The registry aims to assist you (and your loved ones) to easily identify and locate important documents upon request. Registered documents are given a customized registration number detailing their whereabouts. Member's control who they nominate to have access to their registered information.

Registering the location of your Will/documents is optional, however there are many benefits in doing so, including:
- Help those dealing with your estate to easily locate your registered documents, saving them time and money.
- Access an original copy of your signed Will/Documents, to prevent any malicious damage, theft, or loss.
- Reduce the risk of your Will not being found, so State and Territory law does not determine how your assets are divided.
- Help eliminate the chance of an outdated Will being probated.
- Control who you nominate to access your registered information.
- You'll receive a document registration certificate (to store with your original document) for identification purposes.
- A national database, so you can move States/Territories without having to change registries.
- Receive periodic reminder emails to ensure your details are kept up-to-date.
- Free updates to member and nominee details.
- Global account access 24/7.
- Help ensure your wishes are fulfilled.

Individuals aged 18 years and over. Business professionals can register documents on behalf of their clients.

The registry only allows individuals to register their documents. This is to ensure the accuracy of information that is specific to an individual. If you and your partner have a replicated Will or document, you will need to register it individually.

Upon completing the registration process, it is important to print a copy of the registration certificate and store it together with your registered document so it can be correctly identified upon request. You can access your document registration certificate in 'My Digital Vault'.

Any information you give us is strictly used for providing an efficient and effective registry service offering, directly related to our products and services or any authorised third-party service providers.

The Australian Registry of Wills, Deeds and Documents™ values your privacy. Any personal information you provide us is secured via Secure Socket Layer (SSL) technology, which is used as an 'industry standard' to send and receive information over the Internet. Information is encrypted on your system, and decrypted on our server, preventing anyone from accessing any information in between.

Failure to pay your annual Membership fee will result in your account being de-activated (restricted access), until all outstanding payments have been processed by us. Accounts that are inactive for a considerable period of time will be terminated at the discretion of the registry. To renew your Membership, simply 'log in' to your account, select 'Settings', and 'Renew Membership' located next to 'Membership Expiry Date'.

A Member has full control over who has access to their information. Only people you nominate can access your registered information by either:
1. Accessing a link that is sent to the nominee's email address, or
2. Entering a temporary security code sent to the nominee's mobile via SMS.

*Please note: It is your own responsibility to ensure any security information you give us, in relation to nominees accessing your details, can be accessed by that person only.

Up to 12 people.

Upon registering a Document, or creating an intention/memory, you can assign a nominee and elect to notify them either via SMS or email. If you decide not notify an added nominee, they will still have access to your registered information, if and when required. You may also decide to inform them at a later stage, if you choose.

Yes. It is important to register any new Will and/or Document to ensure the correct and most up-to-date Will and/or Document is identified and executed/probated. Upon registration, you will receive a new registration certificate with a unique registration number specifically allocated to that Document.

Sign-In to your account and select the 'Register Documents' menu (left of page) to proceed with registering a document.

There is no time frame limitation for storing your registered information so long as you continue to keep your account active (ensuring your account Membership is paid). In the event your account membership lapses, your details will remain on the system, however your account access will be restricted.

The Registry has two search functions:
1. Registry Search: Search the Registry database to see if a person is listed and whether they have nominated you to have access to their registered information. 'i' (Note, the type of access an enquirer has is solely dependent on what the Member has selected upon registration. If you have registered your Documents through a Professional, they too have access to your registered information).
2. Comprehensive Search: Expand your search with external providers (i.e. State Trustee & Guardian, Probate Office, Local Lawyers and Banks).

An Enquirer must know the Member's full name and date of birth. If you have been given access to a Member's registered information, you will be asked to enter your mobile/email to generate and enter a temporary secure code (via SMS) or link (sent to your registered email).

To perform a 'Comprehensive Search', you will need a copy of the deceased's death certificate for upload, as well as the deceased's details (incl. Full name, Date of Birth).

To access a Member's registered information, you need to have been chosen as a Nominee (by the Member at the time of registration). If you are unable to gain access to a Member's registered information, you may not have been selected as a Nominee, or have entered information that does not correspond with what a Member has registered on the system. You may consider trying to conduct another Registry Search with any other details (i.e. mobile/email) a member may have used to at the time of registration. If your result is unsuccessful, you can proceed to conduct a broader 'Comprehensive Search'.

If you find more than one will, the most recent will revokes (cancels) any previous will made by the deceased. If you find another written document that makes some changes to a will, this is called a 'codicil'. A codicil is a separate document that adds to a will, and if there is a will and a codicil or codicils these documents will be read together. A codicil should also be signed and witnessed by two other persons.

This is a personal decision. Many people choose to share special moments that are particularly important in their life (i.e. graduation, wedding, family, etc.), to ensure their life story remains alive. You decide when you would like to deliver your Memories (instantly, 1, 2, or 3 months' time, or upon ones passing). This way, you control what you sent, when you send it, and how it is delivered (email or SMS).
Some people like to create a short video to their loved ones (including any born/unborn family members), giving you the ability to pass on your message, even after you are gone.

Yes, you can upload files up to a maximum of 200Mb p/file. For video uploads, the maximum file size is 1Gb.
*Note, depending on your membership type, there is a total storage capacity allowance. If you reach the storage capacity for your account, you can upgrade to a higher plan.

Taking control of your Intentions gives you the opportunity to prepare and plan for the inevitable. We provide you with the platform to plan your final celebration/funeral how you would like it to be conducted, as well as any specific instructions to your executor, and obituary notes relating to how you would like your life story to be told/remembered.

By creating an Intention, you can nominate someone (i.e. executor, partner, next of kin) to inform them of your wishes. They will then be able to access your Intention(s) and use it to action your wishes upon one's passing.

Yes. An automatically generated email will be sent to the client informing them of their account access details upon successful registration.

No. The clients you have registered are held under a Professional business account, thus any registered clients remain with the business that you originally registered them with. The account Administrator will be able to assign a new 'Professional' to manage any existing client accounts. Professionals starting with a new firm/company will need to set up a new Professional Member account, in order to register new clients.

The Professional account(s) will be de-activated (i.e. no registration/amendments permitted) until the outstanding subscription fee has been paid. The account Administrator can 'Log In' to the 'Control Panel' to re-new their subscription via the 'Membership' link. Information stored on any Professional Member accounts (that have expired) will remain on our system indefinitely. Any client Member accounts formed by a Professional Member will not be affected and will continue to operate as per normal.

Business professionals registering Documents on behalf of their clients only need to make an initial Once-Off registration payment for the total number of Documents being registered. Clients will receive a free Basic Account Membership, with no ongoing fees.

If, however, a client decides to upgrade their Account Membership, any periodic account Membership fees will be passed on directly to your client.

If, after completing the Free Suitability Questionnaire, a prospective client's circumstances are not suitable for using the Australian Legal Will, we can refer prospective clients to you. The prospective client will answer a number of questions to assist you in pursuing the referral. We recommend you contact the prospective client at the time/date they have specified (usually within 24 hours) to assist them in making a complex Will, and any other documents they may require.

You can keep track of your Referrals in your account and add the stage of progress for each referral for easy monitoring. If you have reached the maximum number of referrals permitted for your account, you can upgrade to a higher membership plan to continue to receive the additional allocated referrals for that plan.

We ask that all Businesses comply with our Terms and Conditions, as well as maintain the Status of the referral within your account. Note, once you receive a referral, it is up to you to follow up and see if the referral becomes an active client.

It is up to a prospective client as to how many referrals they wish to receive (from 1 to 3). Thus, a referral may be exclusive or not, depending on what the individual has requested.

Yes, you can 'transfer referrals' to another Professional User Account, from the Business Administrator Account.
